The Court has received and reviewed Defendant's Motion to Redesignate Certain Materials or in the Alternative Modify the Protective Order. The Court has also received and reviewed Plaintiff's Response to that Motion. The Court notes that Section 13 of the Protective Order (Doc. 34 ) states as follows: "Any party may petition the presiding judge for good cause shown if the party desires relief from a term or condition of this Protective Order." The Court construes Defendant's Motion as, inter alia, a request for relief under this section of the Protective Order. Notwithstanding Section 6(A) of the Protective Order, the Court agrees that there is good cause to allow Defendant to use the documents (and information from these documents) set out in the bullet points on pages 2-3 of the Motion in filing and prosecuting a new Complaint (in a new case), so long as Defendant uses its best efforts to ensure that the documents and associated information are kept confidential by way of sealing the Complaint or portions thereof and sealing any later use of the documents and associated information in that new case. The good cause for this relief is set out in Section III(D) of the Motion. Because the Court's decision allows Defendant to use the documents and associated information to file a new Complaint (in a new case), the Court need not, and will not, address whether the documents and associated information are properly designated as "Confidential Information." Finally, the Court notes that this Order should not be construed as determining the propriety or viability of any Complaint Defendant may choose to file in a new case. Signed by Judge Lee P.
