09/17/24	Zunum Aero Inc v. Boeing Co 2:21-CV-00896 ( W.D. WA )	AMENDED JUDGMENT. Defendants / Counterclaimants The Boeing Company and Boeing HorizonX Ventures, LLC have prevailed on all claims and counterclaims in this matter. The Court DISMISSES Plaintiff / Counter-Defendant Zunum Aero, Inc.'s claims with prejudice. Judgment is entered for HorizonX and against Zunum in the amount of $9,000,000, plus interest as provided in the 2017 and 2018 Note Purchase Agreements. Pursuant to Federal Rule of Civil Procedure 50(c), in the event that judgment as a matter of law for Boeing is reversed, the Court conditionally GRANTS Boeing's motion for a new trial. As to each of the claims on which the jury found against Boeing, the Court finds that the verdict is against the clear weight of the evidence, the awarded damages are excessive, and that a new trial is otherwise necessary to prevent a miscarriage of justice and undue prejudice to Boeing for the reasons discussed in the Court's [744] Order and Boeing's [695] Motion for judgment as a matter of law or, in the alternative, for a new trial.
