Consolidating the deadlines as proposed would shorten the time to respond on liability issues, even if by only a weekend, and that timing may matter in the weeks leading up to trial. The final pretrial conference is reset from October 9 to October 4 at 02:30 PM. Dkt. [316] . In cases like this where a court decides that a patent was not infringed, courts have discretion to hear an invalidity counterclaim or dismiss it with prejudice. Liquid Dynamics Corp. v. Vaughan Co., 355 F.3d 1361, 1371 (Fed. Cir. 2004). If Fiskars had moved on this issue at summary judgment, the court would have declined to exercise jurisdiction over the invalidity counterclaims because there is no live case or controversy between the parties about the patents.
