MINUTE entry before the Honorable Mary M. Rowland: Before the Court is Plaintiffs/Counter-Defendants Toyo's motion to stay execution of the Court's Judgment against Toyo pending appeal and to waive the requirement of a supersedeas bond. In its discretion, a district court may waive the bond requirement. See Fed. R. Civ. Pro. 62(d); Dillon v. City of Chi., 866 F.2d 902 (7th Cir. 1988). Toyo argues that the first four Dillon factors favor waiving the bond requirement: (1) the complexity of the collection process; (2) the amount of time required to obtain a judgment after it is affirmed on appeal; (3) the degree of confidence that the district court has in the availability of Toyo's funds to pay the judgment; and (4) whether "the [judgment debtor's] ability to pay the judgment is so plain that the cost of a bond would be a waste of money". Dillon, 866 F.2d at 904-05. Atturo responds that: In reliance on the financial information contained in Toyo's motion, including the sworn representation of Toyo's Controller that Toyo "could wire the full amount of any judgment to Atturo within ten business days of an affirmance on appeal", Atturo does not oppose Toyo's motion. MINUTE entry before the Honorable Mary M. Rowland: Before the Court is Plaintiffs/Counter-Defendants Toyo's motion to stay execution of the Court's Judgment against Toyo pending appeal and to waive the requirement of a supersedeas bond. The Court has reviewed the motion and its attachments including the sworn declaration of Toyo's controller. In its discretion, a district court may waive the bond requirement. See Fed. R. Civ. Pro. 62(d); Dillon v. City of Chi., 866 F.2d 902, 904-05 (7th Cir. 1988) (waiver of bond requirement was appropriate because the City had the funds to pay the judgment and had a process by which the judgment would be paid quickly following the appeal).
