11/15/24	Factor2 Multimedia Systems LLC v. US Bank National Association 3:24-CV-02872 ( N.D. TX )	ELECTRONIC ORDER: It has come to the Court's attention that Plaintiff's counsel, Benjamin C. Deming, may in fact not be "local counsel" as defined under this Court's Local Civil Rule 83.10. "'Local counsel' means a member of the bar of this court who resides or maintains the attorneys principal office in this district and whose residence or principal office is located within 50 miles of the courthouse in the division in which the case is pending." L. Civ. R. 83.10(a). The address listed for Mr. Deming appears to be a virtual office. His Texas Bar profile shows his address is in Washington D.C. and his primary practice location is Costa Mesa, California. If true, this does not satisfy Rule 83.10(a). Thus, the Court ORDERS Mr. Deming to file an affidavit by November 25, 2024, that his principal office is located in this District and is not a virtual office or that he resides principally in this District. If Mr. Deming cannot file an affidavit swearing to this, Plaintiff shall file the entry of appearance of local counsel who actually satisfies the requirements of Local Civil Rule 83.10(a) by November 25, 2024. If the Court is dissatisfied with Mr. Deming's affidavit, the Court may order Plaintiff to file the entry of new local counsel.
