MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff Pure Edge Lighting, LLC`s Motion to Enforce Settlement (Dkt. 25 , 27 ) against Defendant Fabbian S.R.L. Defendant has not responded to the motion despite being provided (see Dkt. 40 ) the opportunity to do so. For the reasons provided by Plaintiff, the Court finds that (1) the parties entered into a valid and enforcement Settlement Agreement; (2) Defendant breached that Agreement; and (3) as a result of Defendant`s breach, and in accordance with the Settlement Agreement, Plaintiff has suffered irreparable harm to which there is no adequate remedy at law. Plaintiff is therefore entitled to the injunctive relief set forth in the final judgment the Court enters by separate order. Plaintiff states (Dkt. 42 at 3-4) that it intends to file a motion for attorneys` fees under FRCP 54. If and when that happens, the Court will adjudicate the motion, along with any request for costs.
