MINUTES (Text Only) for proceedings held via video conference (Zoom) before Magistrate Judge Chi Soo Kim: MOTION HEARING held on 6/4/2024. Counsel for parties present. For the reasons provided in detail during the hearing, the Court ruled as follows: (1) The prior request to seal [ECF 54] was approved [ECF 57] and also includes the additional documents that were filed after the Joint Statement was filed on May 21. (2) As provided in the parties' Joint Statement, Defendant Leafware agreed to produce its 2023 profit and loss statement. The Court orders Defendant to produce its 2023 profit and loss statement within 7 days of today.(3) Plaintiffs VerTerra and Dwork's motion to compel [ECF 52, 55] is DENIED IN PART as untimely on all issues raised in the motion except the following two issues: (a) Plaintiffs' motion to compel is granted in part as to its request to depose Defendant Leafware about documents Defendant produced late in May 2024. Plaintiffs will be permitted to conduct a single deposition limited to 2 hours or less and limited to questions regarding documents Defendant produced in May 2024. This deposition must be taken and completed within 30 days of today. If the limited deposition regarding Defendant's documents produced in May 2024 changes Plaintiffs' expert's analysis or opinions, Plaintiff will be permitted to supplement its expert disclosures within 1 week of the deposition limited to the late produced information. (b) Regarding the Rule 30(b)(6) deposition of Defendant Leafware on Topics 7 and 8, Plaintiffs are ordered to file the original December 2023 Rule 30(b)(6) deposition notice served on Defendant within 2 business days from today. After this filing, the Court will then take Plaintiffs' motion to compel as to this issue under submission and issue a written order.
