In light of the filing of Plaintiffs Consolidated Amended Complaint ("AMC"), ECF No. 44, and Defendant Shenzhen Keenray Innovations Limited's ("Keenray") filing of a pre-motion conference letter requesting leave to file a motion to dismiss the AMC in lieu of an answer, ECF No. 48, the Court directs the parties to file a completed civil case management plan by September 12, 2023, as further described in the attached mandatory requirements.Defendant Keenray intends to file a motion to dismiss the AMC. See August 26, 2023 Order Setting Motion to Dismiss Briefing Schedule. The mere filing of a motion to dismiss does not warrant a stay of discovery absent good cause. "This mandate of a showing of good cause is critically important" because of the Court's obligation to secure the just, speedy, and inexpensive determination of every action and proceeding."
