The Court ordered Plaintiff Gavrieli Brands, LLC, to show cause why the case should not be dismissed for failure to serve Defendants within 90 days pursuant to Federal Rule of Civil Procedure 4(m). Plaintiff responded that it understands Defendants to be foreign entities based in China and that it is "taking the necessary steps to effectuate foreign service through the Hague Convention."The Court discharges the order to show cause. Although Rule 4(m) may not apply to Defendants if Plaintiff attempts to serve them abroad, Fed R. Civ. P. 4(m), Plaintiff still has a responsibility to diligently prosecute its case against them.
