The status report also advised that, should the newly added claims not be excluded, then the Scheduling Order 48 will need to be amended. On 6/27/2024, Plaintiffs filed a notice of Defendant's failure to comply with the extended deadline to serve amended infringement contentions after order to show cause 72, which advises the Court that Defendant did not comply with the previous Judge's deadline of 6/26/2024 to add new claims and requests that the Court dismiss Defendant's counterclaims as to the newly asserted and still uncharted claims. Based on Defendant's failure to comply with the Court's 6/26/2024 deadline, Defendant's counterclaims relating to the newly asserted and uncharted claims are dismissed. If Plaintiff seeks costs and fees for bringing the motion to show cause and motion to strike, it should file a motion for fees and costs as a sanction, which includes supporting records.
