| 10/25/24 | ORDER. A status conference is scheduled for 11/13/2024 at 10:30 AM before Judge Azrack in Courtroom 920 of the Long Island Courthouse. The Court has serious concerns that this action is frivolous. As an initial matter, the Court has concerns with various procedural aspects of this case, including the joinder of eleven defendants in a single action. See In re BitTorrent Adult Film Copyright Infringement Cases, 296 F.R.D. 80, 82 (E.D.N.Y.) (report and recommendation), adopted by, 296 F.R.D. 80 and Patrick Collins, Inc. v. Doe 1, 288 F.R.D. 233 (E.D.N.Y. 2012). The Court also has serious concerns about the merits of this case and the validity of Plaintiff's patent. The Court directs Plaintiff to review the following website: https://www.momtastic.com/parenting/diy-for-moms/527979-backyard-ring-toss-game/amp/. This website includes pictures of an almost-identical ring toss game that were apparently posted online in 2015, years before the filing of Plaintiff's patent application. Plaintiff must be prepared to address these concerns at the 11/13/2024 status conference. Given these concerns, Plaintiff should consider dismissing this action. Continuing to prosecute this action may warrant the imposition of sanctions against Plaintiff and/or Plaintiff's counsel. In advance of the 11/13/2024 status conference, Plaintiff's counsel is directed to inform Plaintiff of the instant order and to discuss its potential ramifications with Plaintiff.
